terms & conditions for advice seekers

  1. General

    1. Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the www.bolstrlife.com website (“our website”) operated by or services provided by BOLSTR (“us”, “we”, “our”, “BOLSTR”). BOLSTR is the trading name of Goldwolf Limited, a company registered in Hong Kong. 

    2. Your access to and use of the services provided by or through BOLSTR (wherever those services are performed) is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use our services or website. By accessing our website or using our services, you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access our services.

    3. The Advice Seeker Questionnaire and the terms set out herein constitutes the entire agreement between BOLSTR and you, the person whose details are set out in the Advice Seeker Questionnaire (“you”, “your”, the “Client”). You agree to inform BOLSTR of any changes to the details recorded in your Advice Seeker Questionnaire. You must provide us information in the Advice Seeker Questionnaire that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Services.

    4. By completing the Advice Seeker Questionnaire, you agree and declare that you have been given a copy of these Terms and have had the opportunity to ask any questions before purchasing BOLSTR’s services, and that you agree to the terms herein.

    5. The information contained on our website is not a substitute for, and is not intended to replace, independent professional advice. Clients should consider the need to obtain any appropriate professional advice relevant to their own particular circumstances. Clients acknowledge and accept that BOLSTR does not provide or refer Clients to legal, accounting, or any form of fiduciary advice.

  2. Our Services

    1. BOLSTR provides a referral service (hereinafter referred to as “Services”) for Clients to providers of coaching, recruitment and human resources advice (the “Providers” or “Provider”) upon request in consideration of the fees payable by the Client (the “Fees”). The Client agrees that any advice given to them by the Providers is not done on behalf of BOLSTR.

    2. Once connected with a Provider, you agree that any coaching, recruitment and human resources advice services provided by the Provider to you (“Provider Services”) are provided pursuant to a separate contract between you and the Provider.  In consideration for BOLSTR’s Services, you agree that all future Provider Services will be arranged through BOLSTR, so that BOLSTR may charge its referral fee from the Provider. 

    3. Services provided by BOLSTR are on an ‘as is’ basis. The Client is fully aware of the modalities to be applied in the provision of Services and any advice received from Providers (the “Advice”), and has been advised that the result of Services or Advice may not match the expectation of Client and results are dependent on external factors, full participation and the degree of engagement by the Client.

    4. BOLSTR does not provide any legal, professional, medical, psychiatric, psychological or coaching services under this agreement. Clients should always seek independent legal advice before signing any contract related to the Services or Advice. 

  3. Fees & Payment

    1. Once you are notified by BOLSTR that a Provider match has been found, and you agree to the quoted payment over email, BOLSTR will send you a request for payment (PayPal or bank transfer, at the time of writing). 

    2. Any payment for Provider Services made by the Client to BOLSTR will be held by BOLSTR until the Provider confirms that the Provider Services have been provided.  You accept that BOLSTR must make payment of the Provider’s fees upon such confirmation, less BOLSTR’s referral fees. 

    3. Fees for the Services are non-refundable and non-transferable. Any refund or transfer is subject to BOLSTR’s sole discretion, whose decision shall be final. 

  4. Data Collection, Privacy

    1. BOLSTR cares to maintain your privacy. Our goal is to match you to the right advisor - that is the principal reason why we collect information from you. 

    2. BOLSTR collects personal data (i.e. information that identifies Client) (“Personal Data”) from Client for the purposes of: (a) internal administration and maintenance; (b) oral and written communication with Client; (c) sharing Personal Data with the Providers in order to facilitate our Services on a need to know basis, (d) promotion and marketing activities we ourselves undertake (whether directly or through contractors) to communicate with you; and (e) disclosure pursuant to laws, rules and regulation of Hong Kong Special Administrative Region (“HKSAR”) or in compliance with a court order. 

    3. Client may seek copy of Personal Data information from BOLSTR or to correct Personal Data by writing to BOLSTR by email to contact@bolstrlife.com.  

    4. Clients give general consent to share their personal data with Providers by completing the Advice Seeker Questionnaire.

    5. BOLSTR may also disclose such confidential information where it is ethically and/or legally required to do so to appropriate authorities.

  5. Disclaimer

    1. The purpose of Services is to connect you to advisors “Providers” so that you may receive advice related to your career.  By agreeing to these terms and conditions you acknowledge and accept that the benefits of the Advice may take some time and that the Advice is not guaranteed to result in any specific job or career being obtained, compensation being obtained, or conflict being resolved.

    2. The Client agrees to releases, remise and forever discharge BOLSTR, its employees, directors, consultants, its property owner or anyone at BOLSTR from any obligation or liability whatsoever; and to fully indemnify BOLSTR for all losses and damages (including legal costs) for all demands, claims proceedings made against BOLSTR arising out of or in connection with the Services.

    3. BOLSTR does not warrant or represent that the information contained on our website is accurate, current or complete. Clients and users of our website should exercise their own independent skill or judgment or seek professional advice before relying on it. We do not accept any legal liability or responsibility for any injury, loss or damage incurred by the use of, or reliance on, or interpretation of, the information contained on our website.

    4. Failure to complete the Advice Seeker Questionnaire completely and accurately and to update BOLSTR about any changes to the information provided there shall constitute a waiver of all liability for BOLSTR in tort or under this contract. You can amend your Advice Seeker Questionnaire by notifying BOLSTR by email at contact@bolstrlife.com with your name in the Subject Line. We do not accept responsibility for emails that go into spam.

  6. Termination of Services

    1. BOLSTR shall have the right to terminate the provision of Services at any time. The Client may terminate the provision of Services at any time, however all Services previously purchased are non-refundable.

    2. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

    3. The obligation of the Client to make payments through BOLSTR for Provider Services provided after referral survives the termination of this agreement, whether the agreement is terminated by the Client or by BOLSTR.

  7. Changes

    1. BOLSTR shall have the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide notice through our website prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

    2. By continuing to access or use our website or Services after those revisions become effective, you agree to be bound by the revised terms.

  8. Governing Law & Dispute Resolution

    1. The Terms are personal to the parties. The provisions of the Contracts (Rights of Third Parties) Ordinance (Cap 623) do not apply. No person who is not a party to this Agreement shall have any right under the Contracts (Rights of Third Parties) Ordinance to enforce the Terms or to enjoy the benefit of such Terms.

    2. This Agreement is governed by the laws of the HKSAR; and the parties submit to the exclusive jurisdiction of the courts of Hong Kong Special Administrative Region.

    3. In the event of any dispute arising out of or in connection with the Services or the Terms, the parties agree that such dispute shall be submitted in the first instance to mediation through the Hong Kong Mediation Centre or such other mediator as the party may agree and conducted in accordance with the Centre Mediation Rules in effect at the time of the mediation.
